The role, appointment and dismissal of the deputy mayor
(1) The deputy mayor is subordinate to the mayor and, in the situations provided by law,
the legal substitute of the latter, in which case he exercises, in the name of the mayor, the duties
that fall to the mayor. The mayor may delegate part of his duties to the deputy mayor.
(2) The deputy mayor is elected, by secret ballot, with an absolute majority, from among the members
of the local council, at the proposal of the mayor or of the local councillors.
(3) Voting is carried out on the basis of ballot papers. The election of the deputy mayor is
carried out by a decision of the local council.
(4) In the situation where two deputy mayors are elected, the candidates who have
obtained the vote of the absolute majority are declared elected. In this situation, the local council designates, by
decision, which of the two deputy mayors first exercises the capacity of legal substitute of
the mayor.
(5) The dismissal of the deputy mayor may be carried out by the local council, by decision
adopted, by secret ballot, with a two-thirds majority of the number of councillors in office, at
the duly justified proposal of the mayor or of one third of the number of local councillors
in office. The dismissal of the deputy mayor cannot be carried out in the last 6 months of the
mandate of the local council.
(6) In the deliberation and adoption of decisions regarding the election or dismissal from
office of the deputy mayor, the local councillor who is a candidate for the position of
deputy mayor, respectively the deputy mayor in office whose replacement is proposed, also participates and votes.
(7) During the term of office, the deputy mayor retains the status of local councillor,
without benefiting from the allowance related to this status, being subject to the incompatibilities
specific to the position of deputy mayor provided in Book I Title IV of Law no. 161/2003, with
subsequent amendments and additions.
(8) The term of office of the deputy mayor is equal to the term of office of the local council. In
the event that the mandate of the local council ends or the capacity as local councillor ends,
before the expiration of the normal duration of 4 years, the mandate of the
deputy mayor also ends by law, without any other formality.
